In Turkey, the Land Registry and Cadastre is among the established institutions in the country. This institution has about 175 government offices spread around various parts of the country. Due to the huge increase in the buying and selling of houses recently, land sales have increased in the past years. 

The Turkish Land Registry is just like your local marriage registry. There is no way that you can purchase or sell real estate without informing the land registry office in the country. When you buy and sell a property in Turkey, you will have to sign the documents with an officer from the land registry fully present.

In Turkey, the Land Registry is responsible for providing property owners with the land title, which is government guaranteed. They also provide landowners with the title plan that is used to indicate all the necessary boundaries of the property. The property is registered once in the database and records any subsequent changes to the property. Each property entry in the Land Registry also records the leases and the mortgages affecting it.

This way, you are able to prevent any possible frauds and other related scams. This way, you are able to sell or change the property sometime in the future. 


Registering your property in Turkey

In Turkey, all properties must be registered with the Land Registry. This is necessary if it has not been done before. This means that all properties must be registered with the Land Registry. Therefore, this means that any new property ownership in Turkey will have to be registered with the appropriate department. If you are buying, inheriting, or mortgaging a property, it must be recorded at the Land Registry. The Land Registry should be notified about a property if the following condition applies:

  • Owning a property that has not been registered (an unregistered property).
  • Owning a property that has been registered before (new ownership of a pre-registered property).
  • Any new condition of the property, such as the lease, mortgage, declarations of trust, and so on.

The Turkish Land Registry usually records some of the most important details of a property in the country. These records includes:

  • The title register: This indicates the name of the property owner, the property purchase price, the mortgage details of the property, and so on.
  • The title plan: This is used to indicate all the necessary boundaries of the property.
  • The title summary: This part of the record includes the name of the lender and if the nature of the property ownership is leasehold or freehold.

There is a Land Registry at various locations of the country. Before you register your property in the country, you must search to ensure that it has not been registered already. The registration conditions includes:

  • If the property is unregistered: You will have to apply for the property registration and submit all documents with the Land Registry.
  • For registered properties with new owners: You will have to fill in a new application to show any transfer of property ownership or any possible interests affecting the property such as a right of way, a lease, or a mortgage.
